West Virginia regulations: details
Copied from the Word files of each current rule’s Final File on the West Virginia Secretary of State’s Code of State Rules site on October 21, 2026. Check the official page before you rely on a rule.
What is here
- West Virginia, Release 3: the Code of State Rules as the Secretary of State's site (apps.sos.wv.gov/adlaw/csr) served each current rule's Final File in Word form, fetched 2026-10-21 and read by machine: GLO's reading of the Secretary of State's Word export, not the official print; the filed copy, a PDF page image on the same site, is the record and can differ in form. The state's own Content Disclaimer says: "Portions of the information may be incorrect or not current. Any person or entity that relies on any information obtained from this system does so at their own risk." 12,084 of the 12,837 sections GLO found are served, from 1,331 rules in 154 titles (69 print a heading and no text, shown as printed); 753 sections are held, each by name with its reasons (a section may carry several): the two readers read differently (258), the file prints no TITLE and SERIES lines (222), a table (165), a picture or drawn object (83), the readers read the TITLE or SERIES line differently (79), a section number printed more than once (48), an unchecked WordPerfect symbol (47), an unchecked symbol (39), a heading naming another series (29), the next section number missing with no Reserved line, so its end is uncertain (28), a footnote or note mark (21), a running footer line ("8CSR1") in the text (21), a page-number line in the text (20), text numbered as another section's (18), text numbered as the next section's, so the next head was missed (12), text run on into a next section whose head GLO finds no line to cut at (11), a file opening with another series' heading (4), tracked changes (2), another section's head inside its text (2). 51 files are held whole (no section headings found (44), the file prints no TITLE and SERIES lines (12), a file neither reader opens (7), a heading naming another series (4)) and 163 rules were not read (no Word copy linked (144), no Final File named (16), more than one Final File named (3)); those carry no title and series number here, so a citation cannot reach them. Release 1 (served from 2026-10-21 until Release 2) served 167 sections with the defect shown: text running on into the next section where its head was printed in a form the readers missed (that section's number answered not found), page-number lines and running footer lines; Release 2 (2026-10-21) held those 167 by name. Release 3 (2026-10-21) cuts 97 of them at the head line the readers missed (a head printed with no §, with no period, with spaces or punctuation inside its number, run together, as "Article 9.", or a lettered section such as "§42-19-5A."), each piece Release 1's own words, nothing read again: 95 are served again as their own sections and 126 more are served as the sections their heads name, numbers that answered not found before; 2 sections' own pieces and 4 cut-off pieces fail a test and are held by name, 11 run-on sections with no head line GLO can cut at stay held, and the rest of the 167 stay held as Release 2 held them. These tests catch a run-on that carries numbered subsections or a § head of the listed shapes; a swallowed section with neither is not caught. Six WordPerfect typographic characters (quotation marks, apostrophe, en dash, one half, one quarter) are shown as checked by hand on the filed page images. Each section carries its rule's Date Effective as the site's rule list prints it, never a date of its own. The served sections were checked by hand on 20 drawn sections and Release 3's cuts on 20 drawn cut points, so a field fault rarer than about 1 in 7 sections could remain unseen. Nothing here says a section is current or in force; check the filed rule before relying on it.
- Release 3: 12,084 sections from 1,331 rules in 154 titles, copied on October 21, 2026. 69 of them print a heading and no text; we show them as printed and add no text.
- Of the 12,837 sections we found, 753 are held and not shown, each with its reasons: mainly the two readers read differently (258), the file prints no TITLE and SERIES lines (222), a table (165). A held section comes back as held, with its reasons and no text. Held is not absent.
- 51 files are held whole and 163 rules were not read, mostly because the rule’s page links no Word copy of its Final File. These are listed by rule name, not by number, so a citation cannot reach them yet.
- The Word file is the Secretary of State’s export of the filed rule. The filed copy, a PDF page image on the same site, is the record, and the two can differ in form.
- The state’s own Content Disclaimer says: “Portions of the information may be incorrect or not current. Any person or entity that relies on any information obtained from this system does so at their own risk.”
- Each section shows its heading, its text as the Word file holds it, and its rule’s name, agency, type and Date Effective as the Secretary of State’s rule list prints them. That date belongs to the whole rule, not to the section.
- Look a section up as W. Va. Code R. § 90-1-3, 90CSR1-3, or 90-1-3. 90CSR1 lists the sections of that rule: shown and held. A long section comes back in pages, and nothing is cut.
How we checked it
- In Release 4, GLO restored 83 marks in 14 sections (degree and plus-minus signs and one division sign) that the Word files keep as WordPerfect font codes, by a published table of that character set. No filed page image was compared. A mark this rule did not reach may still show as a blank or a box.
- Two separate readers, written with no shared code, read every Word file, each with different tools. A section is shown only where both agree on its number, its heading and every word.
- Older files in Word 97 form print quotation marks, apostrophes, dashes and fractions in a WordPerfect symbol font. We checked six of those characters by hand against the filed page images and show them; any other symbol holds its section.
- A section is held when it carries a table, a picture, a note mark or tracked changes, when the readers differ, when its number is printed twice, or when its file does not print the TITLE and SERIES lines that name its rule.
- A section is also held when its text holds lines numbered as another section’s (the next section’s head was printed in a form our readers missed), a page-number or footer line, or another section’s head, or when the next section number is missing with no Reserved line.
- Before release, we drew 20 shown sections at random and read each one against the Word file’s own paragraphs. All 20 matched. That check reads the Word file’s text, not the filed PDF.
- For Release 3, sections whose text ran on into the next section, because that section’s head was printed in a form our readers missed, are cut at that head line. Each piece is the same words; joined back with the head lines they give the old text character for character. We read 20 drawn cut points by hand.
- One AI system wrote the readers, ran every check and made every reading and ruling, with no second reader.
What it can't tell you
- Whether a section is in force, valid or current, or is good law.
- When a section took effect. The date shown is the whole rule’s Date Effective as the rule list prints it.
- What the held sections, files and rules say, or how the Word export differs from the filed PDF beyond the six characters we checked.
- Whether anything changed after the files were copied.
Known gaps
- 753 sections are held, not shown; the largest group is the two readers read differently (258).
- Release 1, served from October 21, 2026 until Release 2 replaced it the same day, showed 167 sections with text run on into the next section (whose number then answered not found), page-number lines or footer lines. Release 2 held them by name. Release 3 cuts 97 of them at the head line the readers missed: 95 are shown again and 126 sections that answered not found are now shown; 6 pieces and 11 sections with no head line to cut at stay held. A run-on with no numbered lines or head is not caught.
- 51 files and 163 rules are held whole, so their sections are not listed one by one.
- Rules listed as In Progress on the site are not in effect as listed and are not here.
- The sections were read by machine and checked by hand on 20 drawn sections, so a fault rarer than about 1 in 7 sections could remain unseen.
- Keyword search reads only the shown sections. Held sections have no text here and never match.
Notes you may see on an entry
- A held section: “GLO holds this section and does not show its text, because its two readers or the release check did not clear it. Its reasons are listed by name.”
- A section with no text: “The Word file prints this section’s heading and no text. We show it as printed and add no text.”
- A section not in this copy: “Not in this copy of West Virginia’s regulations, neither shown nor held by number. That never means the section does not exist.”
